For most people, pregnancy and giving birth is a joyous time and there
are an estimated 700,000 successful births in the UK every year. Whilst,
in most cases both mother and baby are well cared, occasionally things
do go wrong and the effects can have a traumatic effect on everyone involved.
Whilst in some cases injuries to mother, baby or both are unavoidable,
there are others occasions when the standard of care falls below what
would be expected. As a result many birth injuries can be avoided and
are sometimes the result of incompetence on the part of the doctors or
other medical professionals.
Recent statistics suggest that seven out of every 1000 babies will suffer
an injury during the birth process.
Common injuries to babies include:
Cerebral palsy
Erb's palsy
Facial palsy
Brachial plexus palsy
Umbilical cord complications,
Fractures
Brain damage
Eye infections,
Scarring
Hip dysplasia
Neonatal hypoglycaemia.
Common injuries to mothers include:
Vaginal tears
Anal fissures
Incorrect suturing (sewing) following an episiotomy or a Caesarean
Failure to manage pre-eclampsia
Infection
Birth injury claims and medical negligence
If mother or baby are injured during childbirth, the obstetrician who
oversaw the delivery and/or the midwives present at the birth or who looked
after the baby afterwards may be held accountable. In some cases the hospital
may also be at fault.
Birth injury cases are sometimes the result of a failure to properly assess
or observe unusual conditions, problems and complications during a pregnancy
or birth.
The medical profession has a 'duty of care' towards their patients. This
means that they are responsible for carrying out procedures with due diligence
and in the proper manner. If they fail to do so and their patient suffers
as a result, a medical negligence claim may be made against the staff
involved.
If you believe that you or your child has suffered as a result of a mistake
or negligence during pregnancy or childbirth you may be able to make a
birth injury claim. However it essential that you seek professional legal
advice as soon as possible after the birth.
Birth injury claims are often complex so it is worthwhile contacting a
solicitor that specialises in birth injury claims.
If the birth injury compensation claim is successful, the amount of money
you will receive depends on a number of factors including the severity
of the injury and the cost of appropriate care.
