Many of us fear going to the dentists, but in the vast majority of cases
this fear is unfounded. As with all medical procedures, the staff involved
are highly trained and have a duty of care to their patients.
Unfortunately, on rare occasions, mistakes are made or the standard of
treatment falls below the level that patients have a right to expect.
This may result in personal injury and in such cases it may be possible
to make a dental negligence claim.
What is dental negligence?
Dental negligence is another form of medical negligence. As with medical
negligence claims, for a successful dental negligence claim it will be
necessary to prove that the dentist breached his or her duty of care to
carry out correct treatment in a correct manner.
The most common dental negligence claims include:
Dental negligence through misdiagnosis
Dental negligence through careless work
Dental negligence through inadequate treatment
As with other areas of medical negligence, dental negligence is a very
complicated and complex area of law, so it is vital that anyone who thinks
they are entitled to compensation seeks expert legal opinion as soon as
possible.
The amount of compensation awarded in such cases varies enormously and
will depend on a wide range of factors including the amount of pain and
suffering caused, appearance following the procedure and the cost of further
dental treatment to repair any damage.
An example of a successful claim for dental negligence is as follows:
Dental negligence compensation after loosing 10 teeth
Restaurant worker Mauro Mariani has received £85,000 compensation
from his former dentist in settlement of his claim for negligent treatment.
Mr Mariani, from Oakwood, north London launched the legal claim against
Allan Sands, of Wimpole Street in London's West End after losing 10 teeth
over a four-year period.
During this time he made 140 visits to the dentists, and paid a total
of £11,500.
His lawyers said the payout was one of the largest of its kind and the
compensation for dental negligence will enable Mr Mariani to rebuild his
mouth using the latest dental implant technology.
